As per the Article 10 of the Personal Data Protection Law numbered 6698 (“PDPL”) we, MANPOWER İNSAN KAYNAKLARI LTD. ŞTİ. and MANPOWER SEÇME VE YERLEŞTİRME HİZMETLERİ LTD. ŞTİ.  (“MANPOWER”) would like to inform and enlighten you with this “Informative Note” about the data processing, transfer of processed personal data, methods and legal grounds to collect your personal data and your legal rights set out in the Article 11 of the PDPL. We kindly note that we pay utmost importance to the confidentiality and protection of your personal data and take all technical and administrative measures to protect them.   

Data Controller​

We, MANPOWER as the Data Controller according to the PDPL, hereby declare that we will keep, store, process, classify, update your personal data within the scope of the below purposes and declare or transfer them to third parties to the extent that it is permitted by the PDPL and proportionate to the purpose of processing such data.

Purposes for Processing Your Personal Data

Your Personal Data shall be processed in accordance with your explicit consent and/or the legislation you’re subject to, particularly in cases stipulated under Article 5/2 of PDPL in line with the PDPL and basic principles regulated under such legislation in order for you to benefit from the services provided by MANPOWER. Considering the services performed by MANPOWER, your Personal Data shall be processed during hiring and human resources processes, operations with respect to employment relationships, technical processes to be able meet the third parties’ needs while operating the Company’s commercial activities. The Personal Data shall be kept in conformity with the processing purpose within the required period of time in physical and electronic environment safely. On this wise, MANPOWER complies with all its obligations regulated under all legislation particularly the PDPL.

The Methods and Legal Reason of Personal Data Collection

Since we provide human resources services and we are a private employment agency as MANPOWER, in order to perform our services, your Personal Data shall be collected in different methods which are stated below:

1.The Personal Data provided to MANPOWER directly by you: All information and documents provided to us by you;

2.The Personal Data related to you collected from third parties: All information and documents collected from institutions and organizations in cooperation with MANPOWER and/or customers and government agencies such as Turkish Labour Agency;

3.The Personal Data collected via cookies or similar technologies.

Your Personal Data may be collected automatically or non-automatic ways, in written, orally or electronic environment through MANPOWER General Directorate, branches, MANPOWER and/or contracted institutions’ web sites and similar other channels.

In this context, your Personal Data may be processed and transferred by obtaining your explicit consent in the light of Article 4/2 of PDPL or without your explicit consent in cases where Article 5/2 and 6/3 are applicable.

Transfer of Your Personal Data

MANPOWER will be sharing your Personal Data obtained within the context of the above mentioned processing purposes upon your explicit consent or in other cases regulated principally in applicable legislation under Article 5/2 of PDPL, limited with the data processing conditions and principles regulated under PDPL Article 8 and 9, with including but not limited to our group companies, direct and indirect business partners, clients, suppliers, business partners, independent audit companies in line with the legal context or  governmental authorities who are legally authorized to request these data and other organizations who we have a contract with or provide service to as per our operations.

Transfer of Your Personal Data Abroad

Your Personal Data may be transferred by MANPOWER to persons and organizations located only in foreign countries which to be determined to have satisfactory protection by Data Protection Board (“Board”) and to countries where there is no satisfactory protection by limited to occasions when the data controller undertakes to provide satisfactory protection and obtains the Board’s permission by obtaining your explicit consent as per PDPL Article 4/2 or without obtaining your explicit consent in case of conditions regulated under Article 5/2 and 6/3.

Your Rights as per Article 11 of PDPL

First of all, considering the nature of our commercial activities, it is important for MANPOWER that your personal data that we process and/or keep are true and up-to-date. In this respect, we kindly ask you to inform us within the shortest possible time in case of any change in your personal data.    

Moreover, save for the “Exceptions” stipulated in the Article 28 of the PDPL, you, in your capacity as a data subject, are entitled to the following rights pursuant to the Article 11 of PDPL:

1.to inquire whether your personal data are processed;

2.to ask for information about your personal data that have been processed;

3.to inquire the purpose of processing your personal data and whether they are used in line with this purpose;

4.to know about third parties in Turkey or abroad to whom your personal data have been transferred;

5.where your personal data are processed inaccurately or incompletely, to ask for their correction;

6.to ask for the destruction or deletion of your personal data in line with the conditions stipulated in the Article 7 of PDPL;

7.to ask that such destruction or deletion process is notified to third parties to whom your personal data have been transferred;

8.to object to consequences to your detriment, arising from the analysis of the processed data exclusively via automatic systems;

9.where you suffer a loss due to unlawful process of your personal data, to seek compensation for your loss.

When you exercise your rights in this respect, you need to submit your requests in “writing” and in accordance with the methods determined by MANPOWER. You may submit your request either to our company’s address located at Mecidiyeköy Mah. Oğuz Sok. Rönesans Mecidiyeköy Plaza No:4 K:1 Şişli İstanbul personally or via notary public or via secure electronic signature with the documents identifying your ID and letter explaining the legal rights that you wish to exercise.

It shall be deemed that you, as the owner of the Personal Data, have read and accepted the Personal Data Processing Informative Note before you take any actions on the website of MANPOWER and irrevocably declared, accepted and undertook that you will be deemed as you gave consent to MANPOWER for processing and sharing your Personal Data that you provided by taking an action on website and web page of MANPOWER.
